It is possible that the symptoms that [Mrs A] complained of could have been due to a rupture in the large Baker's cyst and there was an impression from the radiologist that this may have been the case. It is unlikely however that such a rupture would have been responsible for the bruised appearance around the varicose veins which was recorded by both [Dr C] and [Dr B]. Given that the signs of superficial thrombophlebitis had settled by the time [Dr B] saw the patient it is not possible to state whether the proposed diagnosis was correct or not. If the symptoms of aching legs that [Mrs A] complained of were related to the varicose veins and in my opinion that is likely ; then the treatment was highly appropriate. It is clear from [Dr B's] notes which are comprehensive and complete ; and explanatory letter that he felt that the symptoms had been those of an acute superficial thrombophlebitis rather than Baker's cyst. Whether this differential diagnosis was fully explained to [Mrs A] is difficult to say from the evidence supplied. 6. [Mrs A] was not given an opportunity to read the consent form and felt pressured to sign it.
The significance and meaning, to an individual, of commonly experienced symptoms may be influenced by what is going on in the world at large. An example of this last level of explanation lies at the core of this book, an account of the sudden appearance and dramatic rise of a new syndrome, repetitive strain injury RSI ; , in Australia in the 1980s. The author argues that this diagnosis was established by an alliance of doctors and union officials in the context of concern about working conditions and the new technology of the computer keyboard, but in the absence of any scientific basis for the existence of the disease itself. The syndrome was well publicised and the result, Lucire claims, was the equivalent of an epidemic, as workers presented their symptoms for scrutiny and compensation under the new label. The story presents a depressingly familiar litany of reasons for the confrontations that ensued: doctors too willing to apply spurious pathological labels to symptoms; the law fixated with the notion that medical diagnoses are an arbiter of truth about the severity of people's symptoms and disability; and the persisting belief that managing a workplace symptom such as arm pain as a disease, independent of social and psychological circumstances, will make the problem go away. The confrontations between Lucire the psychiatrist and claimants with arm symptoms also illustrate how, just at the point where biology is uncovering the mechanisms of how social and mental events cause bodily symptoms, we are far from having a common language that pulls body and mind together and communicates to patients that symptoms such as pain do.

More major conditions and over 85% received six or more different medications. The equivalent percentages in non-high-cost users were 7% and 16%, respectively. Furthermore, high-cost users with a similar level of comorbidity or taking similar volumes of different medications were more costly than non-highcost users. For example, the average prescription costs for high-cost users taking six or more medications was over , 000 per year. In comparison the same average costs for non-high-cost users were , 000. Investigating the use of medication to treat a common comorbidity--cardiovascular comorbidity--we ascribed this difference to the mix of medications needed to treat comorbidity in high-cost users. Only 6% of prescription costs for non-highcost users were consumed by persons with a high level of cardiovascular comorbidity, requiring treatment with medications for the cardiovascular, nervous, alimentary tract and musculoskeletal systems. Among persistent high-cost users this figure was 30% and in intermittent high-cost users it was 19%. Not All High-Cost Users are the Same Not all high-cost users are the same. We identified a group of high-cost users who predictably fell into the top 5% of costs year after year. These persistent high-cost users differed from intermittent high-cost users with periodic years in the top 5% of costs ; by consuming a greater number of different medications--an average number of 12 different medications in comparison to 10 in intermittent high-cost users. Specifically, they were more likely to have a higher level of cardiovascular morbidity, requiring treatment with a greater mix of medications. Intermittent high-cost users on the other hand, were more likely to have cancer or multiple sclerosis which are treated with immunomodulating drugs. Ten percent of all prescription costs in intermittent high-cost users were due to immunomodulators such as Betaseron and Neupogen , a percentage which was tenfold high than in the other cost groups. We also observed substantial variation in average annual prescription costs within persistent and intermittent high-cost users. Some high-cost users taking few medications or with uncommon conditions such as cystic fibrosis, multiple sclerosis or HIV AIDS, had the highest prescription costs. Some High-Cost Users are Taking Expensive Drugs The daily cost of medication therapy in high-cost users was double that for non-high-cost users. Some of this additional cost difference can be attributed to the greater illness burden of high-costs users, which requires treatment with high-cost medications or switching to higher cost medications.

Either [Dr B] did not perform any such examination or he failed to record an examination. [Dr B], in his reply letter of 24 September 2003 states under point 4 `I have reviewed [Mrs A's] notes for the early part of 2002. The notes of 26 February record upper abdominal symptoms. An abdominal examination was carried out at that time and the findings were recorded as "soft".' Alas I cannot find, in [Dr B's] notes, any entry for 24 February 2002, nor any entry thereabouts which indicates an abdominal examination was carried out. However, [Mrs A], in her affidavit `H' states that on the 16-04-02 `he made only a cursory examination of my pelvic area by hand, feeling for lumps or painful areas and then declared there was no cancer present'. This clearly indicates that [Dr B] did examine [Mrs A's] pelvic area and presumably the rest of her abdomen. This supports my opinion that [Dr B] failed to accurately record his examinations. There are a few other occasions recorded in the notes where any reasonable GP would have carried out at least an abdominal examination in a woman presenting with the symptoms [Mrs A] describes. By itself, each of these diseases may be relatively rare, but as a treatment class, the costs start to add up.
